Eric is an experienced litigator and investigator who is part of the Municipal Bond Recovery team and also represents companies in a variety of industries on matters relating to intellectual property and trade secrecy disputes.

Eric is a Partner in Complex Litigation Group and a member of the firm’s Municipal Bond Recovery team. He handles municipal bond workouts and restructurings and regularly litigates matters in federal and state courts, including preliminary injunctions, jury and bench trials, arbitrations, and mediation.

Public Finance

Eric handles matters related to municipal bond finance and investigations and represents municipal bond trustees and municipal sector investors in litigation and bankruptcy proceedings. Eric has advised clients regarding various bond structures, the property rights of bondholders, the flow of funds under different bonds structures, and potential equitable and statutory remedies. Eric also assists with complex workouts regarding distressed bonds. As part of his representation of creditors in PROMESA proceedings, Eric analyzed complex constitutional issues relating to the relative priorities of Puerto Rico’s debt obligations.

Complex Litigation

Eric regularly litigates commercial disputes, including fiduciary litigation, shareholder disputes, director and officer liability, and fraudulent transfer litigation, with a particular focus on financial institutions and fashion companies. In the area of bankruptcy and creditors’ rights, Eric has served as lead counsel in several bankruptcy and adversary proceedings.

Intellectual Property

Eric has extensive experience with litigating copyright, trademark, trade secret, and rights of publicity disputes, and regularly advises companies on intellectual property issues in a variety of industries and contexts, including project finance, fashion, and music licensing.

Client Work

Eric has represented clients with respect to numerous high profile litigation matters, including:

  • Representing the trustee in a lawsuit brought to defend bondholders’ rights after a payment default by a P3 borrower operating a parking concession on the campus of a public university.
  • Representing interests of municipal bondholders in bankruptcy involving a defaulted industrial development project and various related trade secrecy issues.
  • Representing a public sector investor in a lawsuit brought to exercise remedies against a national provider of addiction services that defaulted on a secured loan, winning on summary judgment.
  • Represented a secured lender in a bankruptcy involving a major publisher of textbooks, in which he assisted in the development and prosecution of a novel copyright strategy.
  • Represented a dental device company in a $45 million breach of contract dispute involving licensing rights.
  • Defended a major digital music service in multiple copyright infringement litigations brought by songwriters and publishers relating to mechanical license requirements, leading to favorable settlements.
  • Defended a progressive rock band in a copyright infringement case concerning album art and band merchandise, leading to a favorable settlement.
  • Defended a major options exchange in a patent infringement action relating to automated options trading, leading to a favorable settlement.

Previous Work

Eric’s past experience includes serving as an Assistant District Attorney in the New York County District Attorney’s Office, working as a database developer in Silicon Alley, and serving as a field artillery officer in the United States Army.
