Montgomery County, Maryland Paid Sick Leave Law Takes Effect October 1, 2016

Employers who do business in Montgomery County, Maryland, should be ready to comply with the requirements of the County’s Earned Sick and Safe Leave Law, which becomes effective October 1, 2016.

The requirements of ESSLL are explained in our Alert published shortly after the law was adopted by the County Council in June 2015. See Montgomery County, Maryland Becomes Latest Jurisdiction to Embrace Paid Sick Leave (July 14, 2015).

ESSLL covers employers with Montgomery County addresses, and employers of employees who work in the County. Before ESSLL takes effect, leave policies should be reviewed to verify compliance, and employers must notify covered employees of how earned leave is accrued; the permitted uses of earned leave; the prohibition against retaliation for exercising ESSLL rights; and the right to file complaints for violation of ESSLL rights.
